Fresno Residents Prevent Cannabis Store from Opening

After making significant efforts to fulfill the necessary compliance standards, inhabitants of Pinedale, a section of Fresno, California, gathered at Fresno City Hall. Their aim was to contest a permit and insist that authorities halt the inauguration of a prospective adult-use cannabis retail outlet.

During a Fresno Planning Commission session on August 16, locals lodged an appeal against Embarc’s Cannabis Conditional Use Permit (CUP) for a planned outlet. Misconceptions about cannabis still exist in various compact communities across California.

Lauren Carpenter, the CEO of Embarc, put forward a proposal to launch a cannabis store at 7363 N. Blackstone Ave. This address hosts approximately 15 other businesses. Carpenter ensured that the proposed location would be at least 1,000 feet away from Pinedale Elementary School, aligning with local rules. Moreover, the establishment satisfied the security standards and urban parking requirements.

However, local residents voiced their concerns. They felt that the aroma of cannabis would dominate the adjacent shopping area and that security personnel could become bothersome. They believed that even the 1,000-foot buffer from the school, though compliant with rules, was still too proximate to easily influenced young students.

Pinedale’s community association and Clovis Unified School District penned letters, urging the cessation of the proposal. Their endeavors to oppose the permit bore fruit.

“Embarc complied with every guideline, ordinance, and code. Anything this enterprise needed for conformity was achieved,” Carpenter stated to High Times. “A total of twenty-six regulatory bodies confirmed our full compliance. Our permit mandates our operation in district two, encompassing the location approved by respective departments and agencies.”

Carpenter added, “Our operational strategy involves weeks to years of discussions with community members, both proponents and opponents of cannabis.”

Monica Diaz, a member of the Planning Commission, remarked to GV Wire that the entrepreneurs had met all stipulations laid out by Fresno for operating a cannabis store. Diaz commended Carpenter for her thoroughness.

Embarc’s CUP faced scrutiny before the Planning Commission, as two individuals from Pinedale challenged it.

Carpenter observed, “Emotion often overrides reality. The decision of a planning commission, by their own recognition, to decline a fully compliant enterprise was startling.”

However, some had a contrary view, asserting that well-regulated dispensaries are benign. Five inhabitants of Pinedale supported Embarc, suggesting the outlet could enhance neighborhood safety. The United Food & Commercial Workers (UFCW) union also advocated for Embarc.

The discussion continued until almost 10 p.m. Members of the Planning Commission collectively decided to reject the permit, deeming the location potentially harmful to the community. Haley Wagner, a member of the Planning Commission, was absent.

Fresno’s Engagement with Adult-Use Cannabis

The city has been tardy in launching adult-use cannabis retail spots. Fresno encountered a budget deficit surpassing $3 million in March, attributed in part to the unhurried initiation of cannabis outlets.

Both Embarc and The Artist Tree commenced operations in Fresno on a day in July 2022. The rest of the businesses granted preliminary licenses are awaiting the nod for their CUPs, a prerequisite for acquiring building permissions and initiating site modifications.

In 2016, Proposition 64 decriminalized cannabis for adults in California. Two years later, Fresno’s electorate greenlit an ordinance taxing recreational cannabis sales, thereby facilitating the opening of dispensaries for adult-use cannabis in the metropolis.

In 2019, amendments were made to Fresno’s civic codes to manage recreational cannabis. By 2021, the municipality began granting the first set of 19 preliminary licenses for cannabis retailers.

Fresno’s officials are reviewing several policies to remedy the city’s lagging initiation of adult-use stores. They are exploring multiple strategies to quicken the unveiling of more outlets in the locale.
