DEA to Reclassify Marijuana, Easing Research and Regulations

The US Drug Enforcement Administration (DEA) is set to downgrade marijuana from a Schedule 1 to a Schedule 3 substance, aligning federal policy more closely with current medical understanding and state laws. This development follows guidance from the Department of Health and Human Services, which itself was based on a positive evaluation from the Food and Drug Administration (FDA). Marijuana will soon be categorized similarly to substances like ketamine and certain codeine products, recognizing its lower potential for abuse and possible medical benefits.

This reclassification reflects a growing acknowledgment of marijuana’s therapeutic potentials, especially after the FDA’s approval of Epidiolex, a cannabidiol-based medication for treating severe epilepsy. Previously categorized with drugs like LSD and heroin, marijuana’s repositioning to Schedule 3 will facilitate more research and ease some regulatory constraints, particularly for federally funded scientists.

While the change might not significantly alter consumer access in states where medical or recreational marijuana is already legal, it will require approximately 15,000 dispensaries to register with the DEA, similar to pharmacies, and adhere to strict reporting standards. This move was reported initially by the Associated Press and has been subsequently verified by multiple sources.

The adjustment will also expedite the research process, offering scientists easier access to marijuana for studies, which has been complicated under its Schedule 1 classification. The DEA’s proposal is awaiting approval from the White House Office of Management and Budget (OMB), with a public commentary period to follow before the final rule is established. According to NBC News, this process could advance as soon as this afternoon with the involvement of Attorney General Merrick Garland.

The Department of Justice has acknowledged ongoing work on this regulation but has not provided further details at this time.
