Blue Whale Enterprises Inc., operating a dispensary for the Cookies brand in New Mexico, has agreed to a $350,000 settlement with regulators to address claims of several infractions during their grand opening last year, according to documents released by the regulatory authorities.
The allegations by the New Mexico Cannabis Control Division against the Albuquerque location included the presence of a minor, promotion of excessive use of cannabis, and unauthorized consumption on the premises during an event on November 18, 2023.
The company recognized the disciplinary measures were due to infractions specified in Case Number 2024-001, agreeing to pay $50,000 for these violations as outlined in the Notice of Contemplated Action provided by the state.
In lieu of a 14-day halt in operations, Blue Whale Enterprises will make an additional payment of $300,000 over a period of 120 days. This fee represents the estimated revenue the company would lose during such a suspension, according to the CCD.
The settlement was endorsed by Todd Stevens, the director of the Cannabis Control Division, on July 19.
Included in the settlement are terms for further penalties should similar breaches recur within the next two years, including an automatic 14-day suspension and potential fines reaching $100,000 for repeat offenses.
Operating at 1340 Broadway Blvd in Albuquerque, the dispensary sought a formal hearing or settlement after being notified of these violations, with local media highlighting the situation at the time.
This agreement concludes the regulatory action that commenced with a notification from state officials on April 8, which included photographic evidence, inspection documentation, testimonies, and social media activities from the event.
